PersonalParty Terms of Use

1. Eligibility & Account Registration

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use PersonalParty. If you are under 18, you confirm that you have permission from a parent or legal guardian. When you create an account or join the waitlist, you must provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

2. App Store Compliance

When you download PersonalParty from the Apple App Store or any other marketplace, you also agree to comply with the applicable store rules. These Terms are consistent with the Apple Media Services Terms and App Store Review Guidelines. In the event of a conflict between these Terms and Apple requirements, the stricter provision applies to protect users.

3. Subscriptions & Payments

PersonalParty may offer free, paid, and promotional plans. Paid subscriptions purchased through the Apple App Store are billed to your Apple ID account and renew automatically unless canceled at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your device settings. We may offer in-app purchases such as Boosts; all sales follow the platform provider’s terms, and we honor applicable refund policies.

4. AI Services & Disclaimers

PersonalParty uses artificial intelligence (AI) to generate chat responses and personas. By using the Services, you acknowledge:

• Accuracy: AI is probabilistic and may generate incorrect, nonsensical, or fictional information. You should not rely on the AI for professional advice (medical, legal, financial, etc.).
• Unpredictability: While we implement safety filters, AI models can occasionally produce unexpected outputs. You agree to use the reporting tools if you encounter inappropriate content.
• No Human Interaction: You are interacting with software, not a human.

5. Acceptable Use & User Content

The Services may allow you to create or upload user-generated content, including AI-generated conversations, custom personas, and bots or automations connected to your account ("User Content"). You are solely responsible for your User Content and for any bots you create, connect, or control through the Services.

You agree not to use the Services for unlawful, harmful, or abusive activities. In particular, you must not create, use, deploy, or share any bots or content that:

• Contains hate speech, harassment, bullying, or threats, or encourages discrimination or violence against any individual or group.
• Contains sexual content that is illegal, exploitative, non-consensual, or otherwise violates our policies, including any sexual content involving minors or that sexualizes minors.
• Promotes or glorifies self-harm, suicide, or other dangerous or violent activities.
• Promotes or facilitates illegal activities, fraud, scams, terrorism, or the sale or distribution of illegal goods or services.
• Infringes or misuses the intellectual property, privacy, or other rights of any person or entity, including by impersonating others without permission.

Additionally, you may not attempt to bypass safety filters or "jailbreak" the AI models, reverse engineer or interfere with the Services, or disrupt other users' enjoyment of PersonalParty. We operate a zero-tolerance policy for harassment, threats, discrimination, sexual exploitation, and any form of child sexual abuse material, and we may report such content or behavior to platform providers or law enforcement where required by law.

You grant PersonalParty a limited license to host and process your User Content solely to operate, maintain, and improve the Services. We reserve the right, at our sole discretion and without prior notice, to remove or hide content, disable or delete bots, restrict features, or suspend or terminate accounts that violate these Terms, our policies, or the Apple App Store Review Guidelines.

6. Intellectual Property

PersonalParty, including all software, graphics, and trademarks, is owned by PersonalParty or its licensors and is protected by copyright and other laws. You may not copy, modify, or distribute the Services without our written consent. Subject to these Terms, we grant you a personal, non-transferable license to use the Services for lawful purposes.

7. Safety & Moderation

We maintain safety protocols, including automated and human review, to keep conversations respectful and compliant with platform policies. We may monitor usage for abuse, disable features that violate our rules, and cooperate with law enforcement where required.

8. Third-Party Services

PersonalParty may integrate with third-party tools, such as messaging platforms or payment processors. We are not responsible for the content or practices of third-party services and encourage you to review their terms and privacy policies.

9. Disclaimer of Warranties

The Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.

10. Limitation of Liability

To the fullest extent permitted by law, PersonalParty will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Services. Our total liability for any claim will not exceed the amount you paid for the Services in the six months preceding the claim.

11. Termination

We may suspend or terminate access if you breach these Terms or engage in harmful conduct. You may stop using the Services at any time. Sections that reasonably should survive termination will continue to apply, including intellectual property, disclaimers, limitations of liability, and dispute resolution.

12. Changes to These Terms

We may update these Terms to reflect new features or legal requirements. We will notify users in-app, by email, or through the App Store when significant changes occur. Continued use after updates constitutes acceptance of the new Terms.
